Privacy Policy

Effective Date: May 22, 2024

1. Introduction

Welcome to XPayr. Your privacy is critically important to us. This Privacy Policy outlines how XPayr ("we," "us," or "our") collects, uses, shares, and protects your information when you use our website, applications, and services (collectively, the "Service").

This policy applies to all users of the Service, including customers and vendors. By accessing or using our Service, you agree to the collection and use of information in accordance with this policy. This policy should be read in conjunction with our Terms of Service.

2. Information We Collect

We collect information to provide and improve our Service. The type of information we collect depends on your interaction with us.

A. Information You Provide Directly to Us:

  • Account Information: When you create an account, we collect your name, email address, username, and password.

  • Profile Information: You may choose to provide additional information for your public profile, such as an avatar or a short bio.

  • Transaction Information (Fiat): When you make a purchase using traditional payment methods (e.g., credit card), we collect necessary information to process the transaction, such as your shipping address, billing address, and phone number. This information is processed by our third-party payment processors.

  • Communications: When you contact our customer support, communicate with other users through our platform, or post reviews, we collect the information you provide in those communications.

B. Information We Collect Automatically:

  • Log and Usage Data: We automatically log information when you access and use the Service. This may include your IP address, browser type, operating system, referral URLs, pages viewed, and timestamps.

  • Cookies and Tracking Technologies: We use cookies, web beacons, and similar technologies to operate and improve our Service, remember your preferences, and for analytics purposes. You can control the use of cookies at the individual browser level.

  • Device Information: We may collect information about the device you are using to access our Service, including the hardware model, operating system, and unique device identifiers.

C. Web3 and Blockchain-Related Information:

Our Service integrates with blockchain technology. When you use these features, we collect specific information:

  • Public Wallet Address: When you choose to connect a non-custodial digital wallet (e.g., MetaMask, Trust Wallet) to our Service for payments, we collect your public wallet address.

  • Transaction Hash (TxID): We collect the transaction hash and associated public data for any cryptocurrency transaction made on our platform. This information is necessary to verify and confirm your payment on the blockchain.

IMPORTANT: We DO NOT collect, store, or have access to your private keys, seed phrases, or wallet passwords. You are solely responsible for the security of your non-custodial wallet.

3. How We Use Your Information

We use the information we collect for various purposes, including:

  • To Provide and Maintain Our Service: To create and manage your account, process transactions, fulfill orders, and facilitate communication between buyers and sellers.

  • To Improve and Personalize the Service: To understand how our users interact with the Service, develop new features, and personalize your experience.

  • For Security and Fraud Prevention: To protect the security and integrity of our platform, detect and prevent fraudulent transactions, and enforce our Terms of Service.

  • To Communicate with You: To send you transactional notifications (e.g., order confirmations, shipping updates), respond to your inquiries, and, if you opt-in, send you marketing communications.

  • To Comply with Legal Obligations: To comply with applicable laws, legal processes, and regulatory requirements.

4. How We Share Your Information

We do not sell your personal information. We may share it in the following circumstances:

  • With Other Users: When you complete a transaction, we share necessary information between the buyer and seller. For example, we provide the seller with the buyer's shipping address to fulfill an order. Your username and any reviews you leave are public.

  • With Service Providers: We share information with third-party vendors and service providers who perform services on our behalf, such as payment processing (e.g., Stripe), cloud hosting (e.g., AWS), data analytics, and customer support.

  • For Legal Reasons: We may disclose your information if we believe it's required by law, subpoena, or other legal process, or to protect the rights, property, or safety of XPayr, our users, or the public.

  • In Case of a Business Transfer: If XPayr is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.

  • On the Public Blockchain: Your public wallet address and transaction hashes are, by their nature, public data recorded on the blockchain. Anyone can view this information using a block explorer.

5. Your Data Rights and Choices

Depending on your location, you may have certain rights regarding your personal information:

  • Access and Update: You can review and update your account information at any time by logging into your account settings.

  • Deletion: You may request the deletion of your account and personal information. Please note that we may need to retain certain information for legal or legitimate business purposes, such as transaction records and fraud prevention. Information recorded on a public blockchain cannot be deleted.

  • Opt-Out of Marketing: You can unsubscribe from our marketing emails at any time by clicking the "unsubscribe" link in the email footer.
